General Terms and Conditions (GTC)


§ 1 Scope of application 

These General Terms and Conditions apply to all legal transactions between the Supplier and a consumer (according to § 13 BGB a "natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed). 

§ 2 Contractual partner

Hoechstmass Balzer is referred to as the supplier in the text of the GTC. 

§ 3 Conclusion of contract and storage of the contract text 

The provisions of these GTC apply to orders which consumers conclude via the online shop of the website www.hoechstmass.com. The contract is concluded with the supplier (see § 2). The contract is concluded with the supplier (see § 2). The presentation and description of the goods on the website www.hoechstmass.com does not constitute a contract offer. By ordering goods by clicking on the button "Order subject to payment" at the end of the ordering process, a consumer makes a binding offer to conclude a purchase contract. The contract is not concluded until the user sends an order confirmation by e-mail. The text of the contract is stored for orders. Consumers receive an e-mail with the order data and the applicable GTC. After conclusion of the contract, the order data can no longer be viewed online. 

§ 4 Payment 

The statutory value added tax and other price components are included in the stated prices. In addition to the stated prices, we charge shipping costs for each delivery, which are displayed to the consumer as shipping costs in the summary before the order is concluded. Furthermore, the shipping costs can be viewed on a separate information page. Payment can be made by credit card (via the paypal system, no paypal account required), paypal, SEPA direct debit, Giropay, Sofort or prepayment. The supplier's bank details are stated on the invoice. 

§ 5 Delivery, delivery restrictions 

Unless the description of a selected product explicitly states otherwise, delivery shall be made within Germany within 7 working days. In other European countries the delivery time is up to 14 days, for third country orders up to 6 weeks. If the ordered product is not immediately available, the consumer will be informed by e-mail. The delivery time begins with the receipt of payment by the supplier.

§ 6 Transfer of risk 

The risk of accidental deterioration or accidental loss of the goods shall remain with the supplier until the goods are handed over to the transport service provider and shall pass to the consumer upon handover to the transport service provider. Defects of the goods, including missing warranted characteristics, must be claimed immediately, at the latest 10 days after arrival of the goods. The supplier may rectify defective goods, in which case he shall bear the transport costs. If a repeated rectification is unsuccessful, the consumer may cancel the contract or reduce the purchase price; he has no further claims unless he is liable for warranted characteristics of the goods. Even otherwise, the supplier shall only be liable if he has acted intentionally or with gross negligence. Minor deviations in material, print or colour are production-related and do not entitle the consumer to make claims. 

§ 7 Retention of title 

The supplier retains ownership of the goods until the purchase price has been received in full. The supplier must be informed immediately of any seizures or other attachments. 

§ 8 Warranty 

The statutory warranty regulations shall apply. 

§ 9 Place of jurisdiction, applicable law 

The exclusive place of jurisdiction is Frankfurt am Main.
In the case of foreign transactions, the law of the Federal Republic of Germany shall apply exclusively.
